HABARI KENYA - TERMS AND CONDITIONS

PASSPORTS: You must be in possession of a passport valid for six (6) months after the return from your holiday.

RESERVATIONS & DEPOSITS: A 20% deposit (minimum $500 per person) of the total air/land/cruise tour cost is required at the time of booking. Programs with three or more countries require a minimum of $1000 per person deposit. Individual arrangements require a non-refundable $250 per person fee before a suggested itinerary is prepared -- to be credited to the cost of the arrangements if accepted. An additional 25% deposit is due upon acceptance of the itinerary. Additional deposits may be required for certain game lodges and deluxe resorts which will be advised. Final payment is due sixty (60) days prior to departure or upon receipt of invoice.

RATES & FARES: All rates shown are accurate at the time of publication and are subject to change. All prices are based upon foreign exchange rates which the company feels will be in effect at the time of departure. These prices are subject to change resulting from fluctuations in exchange rates.

REFUNDS & CANCELLATIONS: All cancellations must be in writing. The per person cancellation charges on the land/cruise costs are: More than 90 days prior to departure/50% of the deposit; 89-60 days prior to departure/100% of the deposit; 59-45 days prior to departure/30% of tour price; 44-30 days/50% of tour price; under 30 days/100% of tour price. In addition to the above, you may be liable for any non-refundable deposits paid to suppliers on your behalf. There is no refund for a partially completed tour or for unused services. TRIP CANCELLATION INSURANCE IS STRONGLY RECOMMENDED.

AIRLINES & AIR FARES: Air fares quoted as estimates based on current tariffs and are subject to change prior to ticketing. Fares are available from gateway cities other than those mentioned in the itineraries. Business and First-Class fares are available upon request. Kenya Adventure has no control over any airline operations and is not responsible for schedule changes, delays or cancellations. Airline delays and extra expenses incurred are the sole responsibility of the airline and not Kenya Adventure.

HOTELS, CRUISE SHIPS, SAFARI CAMPS: Kenya Adventure or its independent suppliers may find it necessary to make substitutions in the accommodations due to circumstances beyond their control. Normally substitutions are of superior or equal quality. If a substitution of equal or superior quality cannot be made, a refund will be paid for the difference.

OPTIONAL ACTIVITIES: At some of the places you will visit on your tour, optional activities will be available from other independent suppliers who are not affiliated with Kenya Adventures . Some of these activities carry with them inherent risks, including that of attack by wild animals, which can cause serious injury. These activities include, but are not limited to: (1) walking safaris; (2) horseback/camel safaris; (3) canoeing; (4) hot air balloons; (5) gorilla trekking; (6) underwater diving and snorkeling; (7) desert excursions. You should be aware that, although precautions are taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Should you elect to participate in such activities while you are on your tour, you are free to do so. However, such participation will be at your own risk. Kenya Adventures assumes no responsibility for your safety. Kenya Adventures requests common sense and caution be exercised while visiting any of the cities and towns on the tour. The company is in no way responsible for incidents or personal/public interaction occurring between a tour member and anyone you may meet while on tour.

FORCE MAJEUR: Kenya Adventure is not liable for acts of God, fire, weather, acts of governments or other authorities, wars, civil disturbances, riots, terrorist acts, strikes, thefts, pilferage, epidemics, quarantines, dangers incident to sea, land and air travel, and other similar acts or incidents beyond its control.

RESPONSIBILITY: Kenya Adventure is a Kenyan based corporation located in Mombasa, purchasing transportation, hotel and cruise accommodations, restaurants and other services from various independent suppliers not affiliated with Kenya Adventures in any way. Although Destinations & Adventures International chooses the best suppliers available, the company has no right to control their operations and CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE OR LOSS which may occur due to (1) wrongful, negligent or arbitrary acts of omission on the part of a supplier, its employees and others not under the direct control of Kenya Adventure, or (2) defects or failures of any aircraft, vessel, automotive vehicle or other equipment under the control of independent suppliers.

TOUR MEMBERS: Kenya Adventure reserves the right to decline to accept or retain any person as a tour member should such person's health, mental condition, physical infirmity or general deportment impede the smooth operation of the tour or the rights, welfare or enjoyment other tour members. Those who have serious health problems, physical or mental, are asked not to sign up.

TRAVELER'S REPRESENTATIONS:

1. I certify I have not recently been treated for, nor am I aware of, any physical or other condition or disability that would create a hazard to myself or other member of this tour.

2. I understand that acceptance of the RESERVATION CONFIRMATION FORM covering this tour and payment of deposit thereof is an acceptance by me of all conditions applicable to the tour. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THOSE CONDITIONS.

3. I understand that Kenya Adventures reserves the right to adjust U.S. Dollar prices, without notice, to reflect fluctuations in the Foreign Exchange Markets.

4. I understand Kenya Adventure reserves the right to withdraw a tour or any part of it, to make such alterations in the itinerary and/or hotel accommodations as seems necessary or desirable, to refuse to accept or retain as a member of the tour any person at any time, and to pass on to tour members any expenditures occasioned by delays or events beyond its control (in the event of an appreciable variation in cost in these, the right is reserved to make such adjustments to rates as necessary.)
